Trademark Tangle: Amazon Faces Lawsuit Over Prime Video’s Off Campus Series
The world of streaming and intellectual property is facing a fresh legal battle as Amazon and Prime Video find themselves at the center of a trademark dispute. Brass Jar Inc., the creators behind the live theatrical brand Drunk Shakespeare, has filed a lawsuit against Amazon, alleging unauthorized use of their valuable trademarks in the context of Prime Video’s original series, Off Campus.
The legal conflict specifically targets the use of the names “Drunk Shakespeare” and “Drunk” by the streaming service. Brass Jar contends that Amazon utilized these marks without proper authorization, arguing that the usage potentially confuses viewers into believing the theatrical production endorsed or licensed the television series.
The dispute zeroes in on a specific moment within the series: Episode 4, titled “The Breakup.” This episode features the fictional college production of Drunk Shakespeare, and Brass Jar alleges that the references within this sequence go beyond mere incidental use of their established trademarks.
When Brass Jar first sought resolution, they contacted Amazon shortly after the eight episodes premiered, hoping to address the trademark concerns. However, the response shifted the focus toward copyright infringement, leading the company to pursue formal litigation.
In the U.S. District Court for the Southern District of Florida, Brass Jar initiated the lawsuit on September 17. The company is seeking substantial damages, including attorneys’ fees, treble damages, and statutory damages of up to $2 million per counterfeit mark for each type of service or good covered by the law.
While Amazon has not yet publicly commented on the lawsuit, the dispute highlights the complex intersection of media production, intellectual property rights, and branding in the streaming age. The case brings into focus the delicate balance between creative freedom and the protection of established brand identities in the digital entertainment landscape.
The series at the heart of the claim, Off Campus, is based on Elle Kennedy’s successful book series, following the journey of students at Briar University. The story centers on Hannah Wells, a music major, and Garrett Graham, the university’s hockey star, as they navigate their relationship.
Prime Video has continued to expand the franchise, renewing the series for a second season. The next installment will focus on the evolving relationship between Allie and Dean, led by new cast members Mika Abdalla and Stephen Kalyn, who will take the lead alongside returning cast members Ella Bright and Belmont Cameli.
